These Terms and Conditions (“Terms”) govern your access to and use of the website https://aiultrasoundphotos.com, our mobile applications, and related services (collectively, the “Services”) operated by Ultrasound AI (“Company,” “we,” “our,” or “us”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility

  • You must be at least 13 years old to use the Services.
  • The Services are intended for adults and parents. They are not directed to children under 13.
  • By using the Services, you represent and warrant that you meet these eligibility requirements.

2. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. Specifically, you agree that you will not:

  • Upload, share, or otherwise transmit any ultrasound images or other content that you do not have the legal right to use.
  • Upload any infringing, harmful, illegal, or abusive content.
  • Interfere with or disrupt the Services, servers, or networks connected to the Services.
  • Attempt to reverse engineer, copy, or misuse any part of the Services.

3. Accounts

  • To use certain features of the Services, you may be required to create an account.
  • You agree to provide accurate, complete, and up-to-date information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • You must promptly notify us of any unauthorized use of your account.

4. Generated Content and Intellectual Property

  • User Content: You retain ownership of ultrasound images that you upload to the Services.
  • Generated Content: When you use the Services to create AI-generated baby images, you are granted a personal, limited, non-exclusive, non-transferable license to download and use the generated content for personal, non-commercial purposes only.
  • Restrictions: Unless you obtain prior written permission from Ultrasound AI, you may not:
    • Sell, license, or commercially exploit generated content.
    • Remove or alter watermarks on free/generated images without purchase.
  • Company IP: Ultrasound AI retains ownership of its software, models, trademarks, and all intellectual property rights related to the Services.

5. Payments and Refunds

  • Payments for Services are processed through Stripe (for web) and RevenueCat (for iOS).
  • You agree to provide valid and accurate payment information.
  • All purchases, including credits and watermark removals, are non-refundable except where required by law.
  • Prices are subject to change at any time, and such changes will be communicated on our Site or app.

6. Image Retention and Deletion

  • Temporary AI pipeline images are deleted automatically after 48 hours.
  • Final and purchased images are retained for 6 months unless you request earlier deletion.
  • You may request deletion of your data and images through the application settings or by contacting support@aiultrasoundphotos.com.

7. Medical Disclaimer

  • The Services and any generated images are provided for entertainment purposes only.
  • The generated content is not a substitute for medical advice, diagnosis, or treatment.
  • Always consult qualified healthcare providers with any questions regarding pregnancy, health conditions, or medical concerns.
  • Ultrasound AI makes no representations or warranties about the accuracy or medical relevance of generated images.

8. Limitation of Liability

  • The Services are provided on an “as is” and “as available” basis without warranties of any kind.
  • To the maximum extent permitted by law, Ultrasound AI disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Ultrasound AI shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to your use of the Services.
  • Our total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Termination

  • We may suspend or terminate your access to the Services at any time, without prior notice or liability, if you violate these Terms or use the Services unlawfully.
  • You may terminate your account at any time by discontinuing use of the Services and requesting deletion of your account.
  • Upon termination, your right to use the Services will immediately cease.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law principles.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Idaho.

11. Changes to Terms

We may update or modify these Terms at any time. The “Last Updated” date at the top of this page indicates when these Terms were last revised.

Your continued use of the Services after changes have been posted constitutes your acceptance of the revised Terms.
